Abstract | Predmet ovog rada je upoznavanje sa vrstama upisa u zemljišne knjige i zemljišnoknjižnim sustavom u Republici Hrvatskoj. Zemljišnoknjižni sustav je sustav publiciranja stvarnih prava, osobnih odnosa i pravnih činjenica na nekretninama. Osnovne funkcije upisa u zemljišne knjige su publicitetna funkcija i zaštita povjerenja u pravnom prometu nekretnina, a zemljišne knjige temelje se na katastarskoj izmjeri zemljišta. Vrste upisa koje postoje u zemljišnoknjižnom sustavu RH su uknjižba, predbilježba te zabilježba. Predmet uknjižbe i predbilježbe su knjižna prava, a predmet zabilježbe su pravne činjenice i osobni odnosi nositelja knjižnih prava. Vrste upisa u zemljišne knjige regulirane su u pozitivnom zakonodavstvu RH Zakonom o zemljišnim knjigama, Zakonom o vlasništvu i drugim stvarnim pravima, Zemljišnoknjižnim poslovnikom te drugim podzakonskim aktima. Ovaj rad predstavlja kvalitetan uvid u zemljišnoknjižno pravo i institute koji se njime bave te opširnije obrađuje svaku pojedinu vrstu upisa u zemljišne knjige sa svojim karakteristikama i pretpostavkama. Uz korištenje navedenih zakona i podzakonskih akata, u radu su korišteni znanstveni članci te brojna stručna literatura kako bi se na što bolji način obradila tema. |

Parallel abstract (English) | The purpose of this study is to focus on attaining additional knowledge on the types of entry into the land register and land ownership system in the Republic of Croatia. Land ownership registry system refers to a system of publication of real rights, personal relations, and judiciary facts concerning real estate. Basic functions of the land register inscription are the function of publication and protection of trust in a judiciary real estate market, and the land register is based upon the cadaster measurement of land. The types of inscription that exist in land ownership system in the Republic of Croatia are registration, pre-registration, and recordation. Judicial facts and personal relations of the owners of land rights are the subject of registration and pre-registration. The types of inscription into the land register are regulated in the positive legislation of the Republic of Croatia by the Land Register Act, Act on Property and Other Real Rights, the Rules of Procedure of the Land Register, and other legislative acts. The purpose of this study is to explore the land ownership rights and the competent institutions on the legal matter, and to provide in detail the data about each specific type of inscription into the land register, with all the pertaining information. Included in the study are the mentioned laws, legal acts, academic articles, and published books, in order to adequately bring light to the subject at hand. |
