Abstract
Predmet ovog rada je zastara kaznenog progona, institut kaznenog prava čiji nastup ima odlučne posljedice za pokretanje ili nastavak kaznenog progona. Upravo zbog velike važnosti pravilnog određenja ovog instituta postoji potreba temeljito ga istražiti. Počevši od povijesnog razvoja zastare, preko određenja njezine pravne prirode i prikaza pozitivno pravnog uređenja i zaključno sa zastarom u kontekstu europskog uhidbenog naloga, cilj rada je temeljito analizirati sve aspekte ovog instituta i prikazati ga u hrvatskom pravnom sustavu. U zaključku se iznose određeni problemi i nelogičnosti koje postoje i nude se njihova rješenja.
Abstract (english)
The subject of this paper is statute of limitations of criminal prosecution, an institute of criminal law which existance has crucial consequences for criminal prosecution. Due to great importance of proper determination of this institute there is an imperative of it's proper research. Starting with historical development of this institute, following with determination of it's legal nature and display of the statute of limitations in croatian legal frame and finally with statute of limitations in European arrest warrant, the purpose of this paper is the complete analysis of this institute and to show it's place in croatian legal system. Certain problems and illogicalities exist and they, together with proposed solutions, are written in the conclusion of this paper.
