Abstract Pobačaj je, unatoč svojoj dugoj povijesti, podložan društvenom i moralnom neodobravanju. U njemu su prisutna dva subjekta koja (ne)jednako moralno obvezuju, a to su majka i fetus. Konzervativci se bore „za život“, odnosno za prava fetusa. Najveći utjecaj na formiranje njihova stava imala je Katolička Crkva koja od samih svojih početaka pobačaj smatra grijehom. Liberali se s druge strane bore „za pravo izbora“, smatrajući da žena ima pravo na autonomiju svoga tijela i reproduktivnog sustava. Ključno pitanje rasprave o pobačaju, zbog čega i dolazi do moralnog neodobravanja, glasi: je li fetus osoba i treba li imati prava aktualne osobe. Pojam „osoba“ pojavio se u ranokršćanskoj teologiji, a u modernoj filozofiji postoje dva suprotstavljena stava o čovjeku kao osobi, to su zapadna i istočna misao. Zapadna je misao „prihvatila“ definiciju osobe Tome Akvinskog koja glasi da je osoba subzistentni pojedinac razumske naravi. Prema njihovom shvaćanju, osoba je ono što je savršeno u prirodi jer je čovjek stvoren na sliku Božju. Istočna misao smatra pojam osobe samo iluzijom i naglašava da se u definicijama osobe izostavlja okolina u kojoj se čovjek nalazi. Osoba nije ono što je savršeno u prirodi, već je čovjek dio te prirode, a „ja“ je struktura koja izaziva postojanje čitavog svijeta. U Republici Hrvatskoj postoje razne kontroverzije oko Zakona o zdravstvenim mjerama za ostvarivanje prava na slobodno odlučivanje o rađanju djece. Taj je zakon donesen 1978. godine u Socijalističkoj Federativnoj Republici Jugoslaviji i još je uvijek na snazi, unatoč odredbi Ustavnoga suda da se zakon izmjeni.
Abstract (english) Despite its long history, abortion is a subject of social and moral disapproval. In this concept, there are two subjects are, (in)equally morally binding: the mother and the fetus. Conservatives fight “for life,” i.e., for the rights of the fetus. This stance was largely shaped by the Catholic Church, which has considered abortion a sin since its beginnings. Liberals, on the other hand, fight “for the right to choose”, and believe that a woman has the right to autonomy of her body and reproductive system. The crucial question in the abortion debate, which is the reason for moral dissent, is whether the fetus is a person and whether it should have the rights of an actual person. The term “person” first appeared in early Christian theology. In modern philosophy, there are two opposing views of human beings as persons, Western thought and Eastern thought. Western thought has “accepted” Thomas Aquinas’ definition of a person, which states that a person is a subsisting individual with a rational nature. According to this understanding, a person is a perfect being in nature because a person is created in the image of God. Eastern thought considers the concept of person to be only an illusion and emphasizes that the definition of a person excludes the environment in which the person is located. Therefore, the person is not the perfect thing in nature, but man is a part of this nature, and the “I” is the structure that causes the existence of the whole world. In the Republic of Croatia, there are various controversies surrounding the Law on Health Measures for the Exercise of the Right to Free Decision on the Birth of a Child. The law was passed in 1978 in the Socialist Federal Republic of Yugoslavia and is still in force, although the Constitutional Court has ordered an amendment to the law.
